A controversial plan to build a 76,000-square-foot warehouse in Mount Laurel is scheduled to go before the Planning Board for a decision on Wednesday.

The proposal for the warehouse, which would be built on a wooded lot at Union Mill Road and Walton Avenue next to Brightview Senior Living, has drawn protests from residents who have testified the warehouse’s truck and car traffic will have an adverse impact on the community.

Board members considered the application from Union Mill Road LLC of Wilton, Connecticut at the August and October meetings. The meeting this week begins at 7 p.m.

The board has voiced concerns about trucks using Fernbrooke Lane, a private road owned by Brightview that would lead to the warehouse. They also said trucks should not use the part of Walton Avenue near Union Mill Road because a bridge could not carry the weight.

Plans were adjusted by the developer to restrict truck traffic to a driveway on Walton Avenue at the top of the property. Trucks would use only Walton Avenue to the north of the warehouse, according to the restrictions.

The developer’s lawyer for the application, Robert S. Baranowski Jr. of the Hyland Levin Shapiro firm in Marlton, told the board at the October meeting that the warehouse is a permitted use for the property.

 “It bears focusing on the fact that a warehouse being located on this property is not introducing a foreign concept for the property,” he said at the meeting.

Truck traffic a big issue as warehouse plan goes before Mount Laurel Planning Board on Thursday

The ability to accommodate large trucks on Walton Avenue and Union Mill Road in Mount Laurel is at the center of a developer’s application to build a 76,000-square-foot warehouse on wooded land near the intersection of the two roads.

Union Mill Road LLC of Wilton, Connecticut, which owns the nearly 25 acres, goes before the Planning Board with its proposal on Thursday evening. The meeting agenda and documents for the application are available on the Township website.

Board members originally were scheduled to hear testimony about Union Mill Road’s application in June, but the hearing was postponed because property owned by the neighboring Brightview Senior Living complex was not a formal part of the application. The warehouse developer has reached an agreement to share a Brightview driveway on Fern Brook Lane, which connects to Union Mill Road.

While that driveway and another that would lead to the warehouse from Walton Avenue were to share equally in truck traffic, a revised plan now calls for all trucks to enter and exit from Walton Avenue.

Trucks, including construction vehicles, will be directed to Walton Avenue as the primary entrance and exit, the developer’s lawyer, Robert S. Baranowski Jr. of the Hyland Levin Shapiro firm in Marlton, told the board in a July 29 letter.

Baranowski also wrote that a sign would be installed at the Brightview driveway on Fern Brook Lane stating “Warehouse Truck Entrance — Use Walton Avenue.”

Increased traffic on nearby roads may require the developer to pay for improvements, according to a letter from Daniel M. McGinnis, the developer’s senior project manager, who works for McMahon Associates Inc. of Yardville in Hamilton Township, Mercer County. The letter is in response to issues cited by the Planning Board’s engineer.

 A “monetary contribution” may be needed from the developer to improve Union Mill Road intersections at Walton Avenue, Briggs Road and Mount Laurel Road, according to the letter from McGinnis.

“A postconstruction traffic study will be conducted to determine this site’s impact on the adjacent roadway and intersections,” he told the Planning Board in the letter.

While all trucks now would be directed to the Walton Avenue driveway, the proposed driveway also comes with its own traffic issues.

A left-turn lane on Walton Avenue into the driveway would be provided, according to the plans. However, the board review showed that a larger curb radius at the driveway exit would be needed to make sure the tractor trailer stays in its lane and does not enter the left-turn entrance lane while exiting.

“The vehicle circulation plan indicates right-turning vehicles exiting the site encroach onto the oncoming left-turn lane into the site,” McGinnis acknowledged in his response letter to the board. “Further widening to accommodate truck turning without this encroachment is not feasible without encroaching on the adjacent property.”

However, McGinnis said: “Based on the expected traffic volumes entering and leaving and site, the likelihood of these conflicting truck movements occurring concurrently is low.”

While the developer has revised its plans and would add a sidewalk along Union Mill Road, one is not offered for Walton Avenue. McGinnis said in his letter that the project engineer “has determined that providing road widening and sidewalk along Walton Avenue is not feasible.”

The proposed warehouse would have 220 parking spaces, 23 trailer dock spaces and 11 trailer parking spaces, the application notes.

A pond on the site would be kept and water quality treatment from runoff would be improved, according to the application. 

A Planning Board review by its engineer, Joseph M. Petrongolo of Remington & Vernick Engineers of Haddonfield, states the proposed warehouse is a permitted use in the industrial zone and the applicant seeks variances for buffer width and the number of parking spaces and waivers from a sidewalk and compensatory plantings.

New Jersey Warehouse Trades for $32 Million — Three Times Its 2017 Price

Sellers Endurance, Thackeray Find Capital Improvements Pay Off

Reflecting the strength of New Jersey’s industrial market, two real estate firms have sold a warehouse property in Burlington County for $32.2 million, nearly three times what they paid for it three years ago.

Endurance Real Estate Group of Radnor, Pennsylvania, and Thackeray Partners of Dallas said they sold 2000 Bishops Gate, a 292,466-square-foot Class A industrial property in Mount Laurel. The companies didn’t disclose who acquired the building.

Endurance and Thackeray bought the warehouse in January 2017 for $12 million from OKI Data Americas of Irving, Texas, according to CoStar data. The building was constructed in 1988 and renovated in 2019, according to the two real estate firms. It features 32-foot-clear ceiling heights, an early suppression, fast response sprinkler system and 35 dock positions.

In a statement, Endurance Senior Vice President Albert Corr said his firm and Thackeray purchased the property knowing it would be vacant in a few months. The two partner companies embarked on a $5 million capital improvement plan to upgrade and modernize the site, according to Corr.

“We demolished 75,000 square feet of office areas in the building, replaced the roof, installed new LED lighting throughout the warehouse and added 10 additional dock doors to meet the demand of today’s industrial tenants,” he said.

Endurance and Thackeray have teamed up on 10 deals in the greater Philadelphia market, Endurance President Benjamin Cohen said in a statement, describing the Mount Laurel partnership as a very successful one.

“Burlington County has seem a tremendous uptick in tenant demand and investor interest in the last few years and with our business plan completed we were able to capitalize on that growth,” Cohen said.

The Mount Laurel property was 100% leased to two tenants at the recent closing.

MINIMIZING RISK IN SELLING OR DECOMMISSIONING INDUSTRIAL PROPERTY UNDER ISRA

Industrial PropertyIn an improving economy, industrial property can change hands frequently. In a declining one, industrial property owners may be forced to wind up operations and close the facility. If you own or intend to purchase or shut down an industrial facility in New Jersey, pay particular attention to the provisions contained in the state’s Industrial Site Recovery Act.

ISRA is a unique environmental law that requires industrial facility owners and operators to investigate and remediate environmentally impacted media prior to the sale, transfer, or decommissioning of certain types of businesses. The thrust behind the law centers on the assumption that such industrial establishments, typically of the manufacturing variety, discharge, intentionally or not, contaminants during their useful life. Thus, before a sale, transfer, or closure, such property should be cleaned up appropriately. While there are exceptions, ISRA generally governs as follows.

ISRA applies to any individual or entity, corporate or governmental, who owns an industrial establishment, owns the real property of an industrial establishment, or operates an industrial establishment in New Jersey. The law only regulates those facilities listed in ISRA’s Appendix C and as defined by the North American Industry Classification System (NAICS) codes therein. Such industrial
establishments falling under ISRA’s purview include those used for chemical manufacturing, hazardous waste treatment and disposal, and utilities, to name a few. In addition, to qualify as an industrial establishment for purposes of ISRA, the business must have operated in the state on or after December 31, 1983 and use and/or store hazardous substances as defined by the state’s Spill Compensation and Control Act.
As the owner or operator of an industrial establishment, the need to comply with ISRA arises after a triggering event. Triggering events include significant changes in ownership or operation, such as business and property sales, cessation of operations, and leases for 99 years or longer. Examples of transactions not subject to ISRA include corporate reorganization not substantially affecting facility ownership, stock transfers, and easement grants. Similarly, portions of solid or hazardous waste facilities and undeveloped or vacant land are not considered industrial establishments for purposes of ISRA.

If a facility is subject to ISRA, and it does not qualify for any of the waivers or exemptions contained therein, the owner or operation must file a General Information Notice within five (5) days of any triggering event. Once notice is made, the owner or operator must conduct an environmental investigation in compliance with New Jersey’s Technical Requirements for Site Remediation,
found at N.J.A.C. 7:26E. At a minimum, a Preliminary Assessment (PA) must be performed by a Licensed Site Remediation Professional (LSRP) to identify any and all Areas of Concern. It should be noted that the scope of a PA differs materially from the American Society for Testing and Materials’ Phase I standard.

As such, if the PA discovers Areas of Concern, a subsequent Site Investigation shall be performed. The Site Investigation will explore the contaminants and determine if such exceed the current remediation standards contained in N.J.A.C. 7:26C. If contaminant levels exceed current standards, a Remedial Action Workplan (RAW) shall be proposed. The LSRP will oversee all remedial investigations and shall deliver a Response Action Outcome (RAO) once the property is deemed to be remediated to current state standards. For establishments undergoing a sale or transfer, an owner or operator must obtain an RAO, or a LSRPcertified RAW, before the transaction. For properties shutting down, an owner or operator must notify NJDEP after closing and submit a RAO or LSRP-certified RAW thereafter.

ISRA does however, allow an owner or operator to transfer ownership without an RAO or RAW in limited circumstances. An owner or operator may submit a remediation certification pursuant to N.J.A.C. 7:26B-3.3(c) instead of a RAO, or the Department can approve a regulated underground storage tank or remediation in progress waiver or a de minimis quality exemption. It should be stressed that both an owner and/or operator are strictly liable, without regard to fault, for compliance with ISRA. An
owner or operator’s failure to comply with ISRA allows a potential purchaser to rescind the sale and recover damages. Thus, it is of great importance, whether you are looking to buy, sell, or shutter an industrial establishment in New Jersey, to contact an attorney experienced in ISRA. The cost of doing business is great, but the cost of non-compliance is even greater.
